DECLARATION

I/We hereby apply for a credit account with Barleys Traffic Management Pty Ltd and declare that the information provided is true and correct. I/We understand that Barleys Traffic Management reserves the right to refuse, amend, or withdraw credit facilities at its discretion. By signing this form, I/We agree to provide a clear copy of each company director’s driver licence (front and back) for identity verification purposes.




TERMS & CONDITIONS OF TRADE

  1. Payment Terms

    Payment terms are strictly within 30 days from the end of the month (EOM) in which the invoice is issued. All invoices issued by Barleys Traffic Management Pty Ltd constitute a payment claim under the Building and Construction Industry Security of Payment Act 2002 (VIC) and/or the Building and Construction Industry Security of Payment Act 1999 (NSW), and may be enforced accordingly.

  2. Application of Conditions

    These Conditions apply to every contract unless otherwise agreed in writing. Any quotation is an invitation to treat and valid for 30 days unless stated otherwise.

  3. Equipment Hire

    Where Barleys Traffic Management hires plant, equipment, tools or related services (‘Equipment’) to the Customer under a contract falling under the construction or related services sector, this Agreement is deemed to incorporate construction-related supply under the relevant Security of Payment legislation (VIC/NSW).

  4. Defaults

    If the Customer fails to pay by the due date, the Supplier may charge interest, recover all costs of recovery, suspend further supplies, or terminate any unperformed contract.

  5. Title & PPSA

    Title to Goods remains with the Supplier until all amounts are paid in full. The Customer grants the Supplier a security interest in the Goods and their proceeds.

  6. Liability

    To the maximum extent permitted by law, the Supplier excludes all implied terms and is not liable for indirect or consequential loss.

  7. Governing Law

    These Conditions are governed by the laws of Victoria and New South Wales, Australia, and the parties submit to the jurisdiction of their courts.
